We always want life to be happy, and by our name we are optimistic that things normally go great, however we acknowledge this is not always the case, and therefore please just use the contact us button at the top of the page to contact us so we can work together to put things right.  For returns and exchanges please click here

We take your privacy and security seriously at Optimist About Fancy Dress. We use third-party banking services to verify payments and protect your personal information. We will never share your data with third parties without your consent. When you make a purchase from us, we may contact you to confirm your order and provide updates on its status. We will never send you unsolicited marketing materials or share your data with other companies. If you have any questions or concerns about our privacy policy, please don't hesitate to contact us.

We take your privacy seriously and to the highest importance. We do not sell any data nor collect any of your data apart from arranging payment and delivery of the amazing items you have chosen. When you purchase from our website, we use a 3rd party to collect card payment, this is Wix Payments, you should read their terms and conditionals before payment, or you may choose to pay by paypal, again you will need to read their terms and conditionals before payment. Other 3rd parties who we will share information with are for delivery purposes, this will be Royal Mail, Hermes, or Yodel, we may use other couriers but we will inform you of this.

Should you sign up to our newsletter, which we really recommend, your email address will be held on the Wix.com platform to ensure you receive information about us, our products, and any offers we have.

Some of our products can be bought wholesale for other retailers to sell. We either have stock ready to dispatch, or we are able to work with supplier to get stock to you, or we can refer you to supplier and manufactures.

Terms and Conditions

1) Who we are

 

  1. In these conditions we/us/our means Jamie Walker trading as Optimist About Fancy Dress on the optimistaboutthis.co.uk website

 

2) Who you are

 

  1. You are any person accessing, using, and purchasing from us on the Optimistaboutthis.co.uk website.

  2. By using the website you are agreeing to these terms and conditions, and will follow them in the spirit they are written.

 

3) What we are

 

  1. We are a website selling products directly to consumers.

  2. We are also able to provide products to other business through wholesale or trade deals, however you will need to contact us directly either through our website contact forms or by the email listed on the website. There may be additional Terms and Conditions that you will need to agree to.

4) Where we are

 

  1. Our registered office is Room 2008, Safestore, 212-214 Broomhill Road, Brislington, Bristol, BS4 5RG.

  2. We operate the website for people to buy from in the United Kingdom of Great Britain and Northern Ireland.

  3. We can send most items outside of the UK, this is only at our discretion, and the costs you pay does not include any export, import, or custom fees, you will be liable for any additional fees.

 

5) When

 

  1. You agree to these conditions once you access and use our website. 

  2. We will dispatch any order received by 5pm UK time on the same day. By dispatch we mean that your purchased item(s) will leave our care either into the care of the courier/ parcel shop, or put into a Royal Mail postbox/ parcel box. Any orders after 5pm, will be dispatched within 24 hours. This applies Monday to Friday,  i.e. Orders after 5pm on a Friday will be dispatched before 5pm on the Monday.

 

6) How

 

  1. These terms are to be understood only in the English language. 

  2. You are agreeing that any court action you wish to pursue, will only occur after you have been in contact with us and have tried to resolve your issue with us. You will undertake court action following any English (and where applicable Welsh) Law. Any Court action will take place in a court of our choosing.

  3. When you place your order, we will need to use some of your personal information to get your chosen item(s) to you. This includes your name, address, telephone number, email address; we will need to share this information with the delivery company so they know where to quickly bring your items. We won’t save your information anywhere else, but it may still be accessible to us. We use Wix.com to host our platform, Godaddy as a domain, and Wixpayments and Paypal as our online payment providers, your information may be collected by these partners.

  5. We reserve the right to remove or add items at anytime. And reserved the right to amend pictures, products and descriptions at any time.

  6. Pictures, prices, descriptions, and any other information on our website can be updated at any time. We provide these to the best of our knowledge, but should be independently checked before purchase. You should check your item within 14 days from delivery date, and let us know if there is an issue within that time.

  7. Our online order process allows you to check and amend any errors before submitting your order to us. Please take the time to read and check your order at each page of the order process.

  8. We will confirm your order only once it has been sent, with any tracking details messages to the email address you have provided.

  9. We aim to keep our website stock availability as correct as possible, and keep any items that are out of stock hidden on the website, or to include information to say it is out of stock on the item page. If we are unable to bring an item to you, we will let you know by email and provide a refund as soon as it is possible but within 7 days.

  10. We reserve the right to cancel any orders at any time for any reason. We do not have to give you a reason as to why your order was cancelled, but we will let you know by email as soon as possible to let you know your order has been cancelled and will provide a refund as soon as possible, but within 7 days.

  11. Each time you order, a new contract is agreed. You should make a copy of these T&Cs offline, and be able to produce them if asked by us or representative of us.

  12. The price listed is to be correct at the time of uploading, there may be times when the price is incorrect, should this occur we may decide to cancel your order as per condition 6.10 or we may contact you as soon as possible to give you the option to pay the extra.

  13. We charge for standard delivery, there may be options to upgrade your delivery. If you choose to upgrade your delivery, but then wish to return your item, we will not refund the upgraded delivery cost.

  14. We usually use Royal Mail and Yodel to deliver your item(s). However we will be happy to discuss this with you should you wish to use another service. There will be an additional cost for this.   15. Prices are quoted on our website are in UK Pounds Sterling, We can not be responsible for prices that are shown in another currency or any exchange rate. 

  16. Your credit card company may charge their own exchange rate where the payment currency differs from your account. Refunds will be provided in UK Pounds Sterling only. We cannot be held responsible for any loss due to exchange rate fluctuations.

  17. You must only use Bank details that belong to you, we will report any uses of unauthorised or attempted unauthorised uses of bank details to the relevant bank or authorities. 

  18. You should provide us with full information as requested throughout the process of ordering, this is to ensure we can provide the best service, and to ensure the item(s) you have chosen are delivered to you.

  19. Payment will be taken when you order the item.

  20. If the delivery and billing address differ we may enquire as to why this is. If we can not satisfied or you are unable to provide evidence we may cancel the order as per 6.10

  21. We have links on our website to other websites, these websites are not owned or operated by us. We accept no responsibilities for anything on those websites. The links are for information only. You should urge caution and ensure you agree to that company's website rules and T&Cs.

  22. You acknowledge that we do not make, manufacture, design any of the products we currently sell. The products are to our knowledge as described, and manufactured to a high standard, 

  23. If you break any of these conditions and we do not take action, that does not mean we won’t take action to other breaches where you may break other parts of the contracts. 

  24. Each use of this website, and each purchase is set to a new contract between us.

  25. Should any part of these T&C be invalided by a court or are unenforceable, this means only that section discussed but the rest of the T&Cs are still to be followed.

  26. We encourage you to share our website, and URL links, ONLY in a fair, legal, positive way to support our website. You must not established any link as to being a representative, owner, employee or in any way connected to us, unless you are.

  27. You agree that any comments, pictures, videos or feedback you send to us either directly, through social media, or through a third party, can be used by us in a fair way. We will try to minimise any personal information as such we may use a pseudonym, or use a social media handle linking back to yourself. You also have a option to contact us to let use know if you don’t wish for us to use this information, please use the contact information in 1.1 or https://www.optimistaboutthis.co.uk/contact

  28. If you find we have used any of your picture, information, or comments which are copyrighted, please contact us immediately and we will remove any content as quickly as it is possible.

  29. Some of our products may not be returnable, either due to personalisation or hygiene reasons. We will try and state this on the product page, however you are welcome to contact us to discuss as per 1.1 before you purchase, we will also advise when you contact us per 6.10 if the item can not be returned due to it being personalised or for hygiene reasons.
